I was working in Gambia since October 2025 until January 2025, unfortunately the Company contract was terminated by the states and I was offered to Move to G. 1. Your rights regarding the employment period in Gambia (2018–2025)
According to the labor laws in Gambia and internationally recognized employment standards, the employer is obligated, upon termination of the employment relationship or when transferring an employee to another country, to do the following:
Pay the full financial compensation for unused annual leave
Annual leave entitlement is a vested right that does not lapse with time, nor due to the administrative nature of the employee’s position, and it cannot be denied.
Therefore, your request to receive compensation for accumulated leave from 2018 to January 2025 is legitimate and legally binding on the company.
2. The responsibility lies with the company, not the employee
Even if you were supporting administrative tasks, the company’s management is legally responsible for:
Recording annual leave
Approving annual leave
Paying or compensating for unused leave
You cannot be held responsible for the company’s failure to pay these entitlements throughout those years.
3. Separation between the Gambia contract and the Guinea-Bissau contract
The company is legally obligated to settle all your rights related to your employment in Gambia before initiating the new contract in Guinea-Bissau.
It is not legally permissible to link the settlement of the previous contract’s entitlements to the signing of the new contract.
4. Seniority (Ancienneté)
Since you did not sign any document waiving your seniority, the transfer of your work to Guinea-Bissau is considered:
A continuation of the same employment relationship,
Therefore, your full previous seniority must be recognized without discussion.
5. The response issued by your manager
His response does not change your legal position.
The obligation to pay your leave entitlements remains, whether he agrees or not, because:
The right is established,
The employer is responsible,
The previous failure to pay does not justify denying the right now.

1. Background:
• In October 2024, I enrolled in a training course provided by a company that operates through YouTube, Instagram, and an official website (I also have full details about the trainer).
• The agreement was that the course would be completed within one month (two lectures per week).
• Unfortunately, nearly a year has passed, and the course has not been completed due to continuous delays and lack of response. I have all evidence documented in WhatsApp screenshots.
• Additionally, there was a supplier who promised delivery within 10 days, but the delivery was delayed for more than 40 days, which caused direct damage to my business (the products did not reach influencers on time).
2. Current Issue:
• The company now refuses to refund my payment, claiming that I spoke inappropriately with the trainer.
• They based their decision on an audio recording of a Zoom call.
• However, I was residing in Germany during the call, and I never gave my consent to be recorded.
• According to German law (§201 StGB), recording a person without their consent is a criminal offense punishable by a fine or imprisonment of up to 3 years.

• I never intended to insult the trainer; what happened was simply a misunderstanding due to my limited Arabic language skills.
• The company itself admitted in an official WhatsApp message that a recording exists, which serves as proof of committing the crime of illegal recording.
• I have already sent them a formal notice, giving them 7 days to refund the amount, otherwise I will proceed with legal actions in both Germany and Egypt.
• I am a resident in Germany and I have legal insurance (Rechtsschutzversicherung) that fully covers all legal costs.
4. My Questions:
• What is the best legal course of action for me to take in Egypt?
• Should I first file a criminal complaint regarding the illegal recording?
• Or should I directly initiate a civil lawsuit to recover my money and claim damages?
• Can I also pursue compensation for both material and moral damages?
