What is a civil suit?

A civil lawsuit is a legal procedure used to resolve disputes between individuals or legal entities (such as companies or institutions) when one party believes their rights have been violated by another party. Its purpose is not punishment, as in criminal cases, but rather to recover a right, compensate for damages, or compel the other party to perform a legal obligation.

  • Example: A person is injured in an accident due to the negligence of another party and seeks compensation.
  • Real Estate Disputes
  • Example: A dispute over ownership of a property or land boundaries.

Steps and procedures for filing a civil lawsuit

  • Filing the Claim
  • Drafted by a lawyer and filed with the clerk of the competent court.
  • Setting the hearing and notifying the opponent
  • A date is set for the hearing, and the other party is formally notified.
  • Exchange of memoranda and documents
  • Each party submits their defenses, pleadings, and documents.
  • Investigation if necessary
  • Hearing witnesses or requesting an expert (for example, in real estate or accounting cases).
  • Pleading and Judgment
  • Ends with the court issuing a preliminary ruling.
  • Appeal if grounds exist
  • The ruling may be appealed to a higher court, followed by an appeal for cassation in some cases.

Levels of litigation

  • District Court
  • Holds jurisdiction over civil cases of low value (under approximately 100,000 Egyptian pounds).
  • Court of First Instance
  • Holds jurisdiction over cases of higher value or more complex cases.
  • Court of Appeal
  • Hears appeals against first-instance rulings.
  • Court of Cassation
  • Does not review the facts of the case, but rather reviews the legal application.

  • Evidence of the damage or the claimed right (certificates, photos, correspondence, receipts, etc.)
  • Proof of identity (passport or ID card)
