What protective conditions can a foreign wife add to her marriage contract?
Egyptian law allows both parties to add conditions to the contract. If the husband breaks a condition, the wife has the right to go to court and ask for divorce. Common protective clauses for a foreign wife include:
- He cannot take a second wife without her written consent
- He cannot force her to leave her home country or move without her agreement
- She keeps her own passport at all times — he cannot hold it
- She has the right to travel back to her home country for a set number of days per year
- He must maintain her residence permit (visa status) in Egypt throughout the marriage
These conditions must be written clearly inside the contract itself. A vague or verbal agreement has no legal weight.
Can the wife be given the right to divorce herself (without needing the husband)?
Yes. This is called delegated divorce (Tafweed al-Talaq). The husband can give the wife the power to divorce herself if certain events happen — for example:
- He travels abroad for more than one year without a valid reason
- He marries another woman without telling her
- He forces her to leave Egypt against her will
If she exercises this right, it counts as a regular divorce with full financial rights.
