Study Residency For A Foreign Child In Egypt

1) Does a 3–4 year old foreign child need a study residency in Egypt?

Yes.
If the child will join a nursery, KG, or school in Egypt, the child must have a valid residence permit, usually a study residency or another legally accepted residency.

What papers are needed to study residency in Egypt?

The main papers are

  • Child’s valid passport
  • School or KG enrollment letter
  • Birth certificate
  • Photos
  • Residence application form

The most important paper is the official school letter showing the child is enrolled

Which legal rule covers the child’s legal capacity (ahliya)?

Under Article 11 of the Egyptian Civil Code, a person’s civil status and legal capacity are governed by the law of their nationality.

This means

if the child is foreign,
the child’s legal capacity, minority, and age of majority
are decided by the law of the child’s home country.

So the rule of ahliya (legal capacity) applies to foreign children as well.

Does the child’s young age remove the residency requirement?

No.
The child’s age does not remove the immigration requirement.

Even if the child is only

  • 3 years old
  • 4 years old

the child still needs a valid legal residency to study in Egypt.

What is the legal idea in simple words?

There are two separate legal issues:

  • Legal capacity (Ahliya): decided by the child’s national law (Article 11 Civil Code)
  • Residence for study: decided by Egyptian immigration and education rules

So

  • capacity = nationality law
  • study residence = Egyptian residence rules

This is why a foreign child may be a minor under their national law, but still must get a study residence permit in Egypt.
